PHOTO RELEASE BY OWNER

You hereby consent to and authorize MTV Networks On Campus Inc., a subsidiary of Viacom International Inc. (“MTVN”) to use and reproduce your submitted photograph(s) (the "Photograph(s)") and your response to questions (the “Response(s)”) (the Photograph(s) and Response(s) collectively, the “Submission(s)”) on a gratis basis for the benefit of MTVN in connection with the mtvU and The Jed Foundation initiative tentatively entitled “Half of Us” (the "Production"). MTVN, its licensees, successors and/or assigns shall have the right to exhibit, transmit and distribute your Submission(s) in any and all markets and media throughout the world, in perpetuity and shall have the right to include the Submission(s) in the advertising and promotion of the Production.

By providing your Submission(s) (including the Photograph(s), represent and warrant that you are the sole proprietor of all rights in and to the Submission(s); that you have full power and authority to grant the rights granted to MTVN herein; that you have obtained all rights, consents and permissions, including but not limited to those of persons appearing in the Photograph(s), necessary to grant the rights granted herein; and that the use of the Submission(s) by MTVN as set forth above shall not violate or infringe upon the rights of any individual or entity, including but not limited to the rights of any person appearing in the Photograph(s); and that the Submission(s) are free and clear of any liens or claims with respect to the use of the Submission(s) in the manner authorized herein, and that such use authorized herein will not give rise to any claims of infringement, defamation, invasion of privacy, publicity, vclaims for payment of re-use fees or residuals, or any other claims.

By providing your Submission(s), you shall defend, indemnify and hold MTVN, its officers, directors and employees harmless from and against any and all claims, damages, liabilities, costs and expenses (including reasonable attorney’s fees) arising out of or relating to a breach or alleged breach of the representations or warranties provided herein. You further agree that in no event shall you have the right to enjoin the development, production, distribution or exploitation of the Production.
